Terms of Service

1. Acceptance of Terms

Welcome to Lore! These Terms of Service ("Terms") are a legal agreement between you and Lore Platforms, Inc. ("Lore," "we," "us," or "our") governing your use of the Lore mobile application and related services (collectively, the "Service").

By creating an account or using Lore, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms include our Privacy Policy and Community Guidelines, which are incorporated by reference.

2. Eligibility

To use Lore, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law

If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

We reserve the right to request proof of age and to terminate accounts if we believe a user does not meet these requirements.

3. Account Registration & Security

Creating an Account

To access most features, you must create an account by providing:

• A valid email address
• A username
• A password

You agree to provide accurate, current, and complete information.

Your Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You may not:

• Share your account credentials with others
• Create multiple accounts for deceptive purposes
• Use another person's account without permission

Account Termination

You may delete your account at any time through the app or by contacting us.

We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

4. User Content & Licensing

What is User Content?

"User Content" means any content you create, upload, or share through Lore, including:

• Audio stories
• Story titles and descriptions
• Cover images
• Profile information
• Comments and ratings

You Own Your Content

You retain full ownership of any User Content you create. We do not claim ownership of your stories or other content.

License You Grant to Lore

By uploading User Content, you grant Lore a non-exclusive, worldwide, royalty-free license to:

• Host, store, and display your content
• Distribute your content to other users through the Service
• Create technical copies necessary to operate the Service (backups, caching, etc.)
• Use your content for promotional purposes (e.g., featuring popular stories)

This license:

• Continues only as long as your content remains on Lore
• Ends when you delete your content (except for copies made by other users or required for legal compliance)
• Does not prevent you from using your content elsewhere
• Does not give us the right to sell your content to third parties

Your Rights

You may:

• Remove your content from Lore at any time
• Use your content on other platforms simultaneously
• License or sell your content to others

Your Responsibilities

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your content does not infringe any third party's intellectual property rights
• Your content complies with our Community Guidelines
• You have obtained necessary permissions from any individuals featured in your content

5. Acceptable Use Policy

You agree to use Lore in a manner that is:

• Legal and ethical
• Respectful of other users
• Consistent with the intended purpose of the Service

You May

• Listen to stories and explore locations
• Create and share your own stories
• Rate and favorite stories
• Report inappropriate content
• Use the Service for personal, non-commercial purposes

You May Not

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Harass, abuse, or threaten other users
• Impersonate any person or entity
• Spam, advertise, or solicit without permission
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service
• Use automated tools to access the Service without permission
• Reverse engineer or attempt to extract source code
• Use the Service for any commercial purpose without our written consent

6. Prohibited Content & Activities

Prohibited Content

You may not create or upload content that:

Illegal Content

• Violates any law or regulation
• Promotes illegal activities
• Contains content illegal to possess or distribute

Harmful Content

• Threatens, harasses, or bullies others
• Contains hate speech targeting protected groups
• Promotes violence or self-harm
• Contains personal information about others without consent

Sexual Content

• Contains pornography or sexually explicit material
• Depicts minors in a sexual manner (strictly prohibited, reported to authorities)

Deceptive Content

• Spreads false information presented as fact
• Impersonates real individuals without permission
• Misleads users about the content or its purpose

Location-Specific Restrictions

Because Lore stories are tied to physical locations:

• Do not place stories in locations intended to harass specific individuals
• Do not create stories that endanger users (leading them to dangerous locations)
• Do not trespass to create or access stories
• Respect private property and restricted areas

Enforcement

We reserve the right to:

• Remove any content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal content to law enforcement
• Cooperate with legal investigations

7. Subscriptions & Payments

Free and Premium Tiers

Lore offers both free access and premium subscription options. Features available in each tier may change over time.

Subscription Terms

If you purchase a subscription:

• Subscriptions automatically renew until canceled
• You will be charged at the beginning of each billing period
• Prices may change with notice before your next billing period
• You can cancel anytime through the App Store or Google Play

Refunds

Refund policies are governed by Apple (App Store) or Google (Play Store) depending on where you purchased.

Payment Processing

Payments are processed by Stripe and the relevant app store. We do not store your full payment card information.

8. Intellectual Property Rights

Lore's Property

The Service, including its design, features, and content (excluding User Content), is owned by Lore and protected by copyright, trademark, and other laws.

This includes:

• The Lore name, logo, and branding
• App design and user interface
• Proprietary algorithms and technology
• Original content created by Lore

You may not copy, modify, distribute, or create derivative works of our intellectual property without written permission.

Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without any obligation to you.

9. Third-Party Services

Lore integrates with third-party services including:

• Stripe for payments
• Mapbox for maps
• Apple/Google for app distribution

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

Links to third-party websites or services are not endorsements. Access them at your own risk.

10. Disclaimers & Limitations of Liability

Service Provided "As Is"

We specifically disclaim warranties of:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation

Location and Safety

Lore provides stories tied to real-world locations. We do not guarantee:

• The safety of any location
• Accuracy of maps or directions
• That locations are publicly accessible

You are solely responsible for your own safety when traveling to story locations. Do not trespass, enter dangerous areas, or engage in unsafe behavior to access stories.

Limitation of Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lore and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity

12. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@loreplatforms.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Arbitration Agreement

You and Lore agree to resolve any disputes through binding arbitration rather than in court, except:

• Either party may bring claims in small claims court if eligible
• Either party may seek injunctive relief in court for intellectual property violations

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules. The arbitration will be held in Delaware or remotely.

Class Action Waiver

You waive the right to participate in class actions or class-wide arbitration. Disputes must be brought individually.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@loreplatforms.com within 30 days of accepting these Terms.

13. Termination

By You

You may terminate your account at any time by deleting your account through the app or contacting us.

By Us

We may terminate or suspend your account immediately, without notice, for:

• Violating these Terms
• Violating our Community Guidelines
• Conduct we deem harmful to other users or the Service
• Extended inactivity
• Legal or regulatory requirements

Effect of Termination

Upon termination:

• Your license to use the Service ends
• You remain responsible for any obligations incurred before termination
• Provisions that by their nature should survive (indemnification, limitation of liability, dispute resolution) will survive

14. Modifications to Terms

We may modify these Terms at any time. Changes will be effective when posted unless otherwise specified.

For significant changes, we will:

• Provide notice through the app or email
• Give you an opportunity to review before continued use constitutes acceptance

If you disagree with changes, your remedy is to stop using the Service.

15. Severability & General Provisions

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Lore.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

We may assign our rights under these Terms. You may not assign your rights without our written consent.
